Version 1.1
Effective Date: October 2, 2026
These Terms of Use govern access to the MorningHello mobile application for iPhone.
Please read these Terms carefully before using the Service. By installing the App, completing onboarding, or tapping “I Have Read and Agree,” you confirm that you have read, understood, and accepted these MorningHello Terms. If you do not agree, do not use the Service.
Terms of Use for the App
1. Service Owner and Contact Information
The Service is provided by Oxana Krylova, a sole proprietor registered in Israel.
Email: krylov.oxana@gmail.com
2. Purpose of MorningHello
MorningHello helps users stay in regular contact with people they care about.
In the App, a user can:
• check in by tapping “I’m OK”;
• receive daily, holiday, and birthday cards;
• edit a greeting before sending it;
• save and send cards with a personal message;
• add one or two emergency contacts;
• use the missed check-in notification system;
• optionally save information for up to two pets;
• create reminders for staying in touch with people they care about.
3. MorningHello Is Not an Emergency Service
MorningHello is not a medical, security, rescue, dispatch, or other emergency service, and it does not provide continuous monitoring.
A missed “I’m OK” check-in does not confirm that a user is in danger.
If there is a threat to life, health, or safety, contact local emergency services immediately.
Do not rely on MorningHello as the only way to monitor safety or stay in contact.
Information about local emergency services that may be displayed based on the selected country of residence is provided for general reference only. Users must independently verify the current telephone numbers and procedures for contacting emergency services in their country.
4. Age Requirements
MorningHello may be used independently by people age 16 or older.
A user under age 16 may use the Service only with the prior consent and under the responsibility of a parent or legal guardian.
5. Onboarding and Profile
To begin using all App features, the user completes onboarding, fills out the required profile fields, and adds at least one emergency contact.
The user profile may include the user’s name, form of address, day and month of birth, telephone number, country of residence, selected check-in interval, and other settings required for the operation of the Service.
The telephone number may be used to send codes and important service messages related to subscriptions, access recovery, setup, and the operation of MorningHello. The telephone number is not used for advertising messages without the user’s separate consent.
The country of residence is used for regional Service settings, selecting an appropriate communication format, and displaying general information about local emergency services. MorningHello does not automatically contact emergency services.
The user is responsible for the accuracy of their telephone number, country of residence, and other profile information.
6. Free Trial and Subscription
Access to MorningHello features is provided through an auto-renewable App Store subscription.
For certain plans, the App Store may offer a free introductory period. Its duration, availability to a particular user, and eligibility for another offer are determined by Apple and shown before the purchase is confirmed.
After the free trial ends, the selected subscription automatically becomes paid unless the user cancels it in Apple settings before the renewal date.
Deleting the App from an iPhone does not cancel an active subscription. Subscription management and cancellation are handled through the user’s Apple Account settings.
7. Emergency Contacts
A user may add one or two emergency contacts.
By adding a contact, the user confirms that they are authorized to provide that person’s contact details to MorningHello for missed check-in notifications.
Emergency notifications may be sent only to contacts who have confirmed their consent and have an active status in the MorningHello system.
8. How Missed Check-In Notifications Work
When the user taps “I’m OK,” a timestamp is sent to the server.
If the server does not receive another check-in before the selected interval ends, MorningHello may attempt to send a notification to confirmed active emergency contacts.
Such a notification does not confirm that an emergency has occurred.
Changes to the profile, pet information, emergency contacts, subscription, emotional state, or reminders do not count as an “I’m OK” check-in and do not extend the monitoring interval.
9. Pet Information
A user may optionally save information for up to two pets.
Pet information may include:
• the pet’s name;
• the type of animal;
• information about where the pet is located;
• feeding instructions;
• a photograph of the food packaging;
• medication information;
• allergies and important health information;
• behavioral information;
• the veterinary clinic’s name and telephone number;
• the location of the leash, carrier, and other necessary items;
• additional care instructions.
Completing the pet form is voluntary. The user determines the amount of information they provide.
Pet information and the food photograph may be transmitted to and stored on MorningHello servers. Following a missed check-in, this information may be provided only to confirmed emergency contacts to help them arrange assistance for the pet.
Pet information is not disclosed to the purchaser of a sponsored subscription solely because that person paid for access. A purchaser may receive this information only if they have been separately added and confirmed as an emergency contact.
The user confirms that they are authorized to provide the uploaded information and photograph. The photograph should not contain identity documents, banking information, passwords, access codes, or other information unrelated to the pet’s care.
MorningHello is not a veterinary service and does not verify the accuracy of feeding, medication, or pet-care instructions.
10. Technical Limitations
MorningHello does not guarantee the delivery, timing, or receipt of any emergency notification.
Users are responsible for keeping contact details current, checking their connection, and maintaining a backup method of communication.
The availability of servers, internet access, the App Store, telecommunications providers, email services, and messaging applications may affect the operation of certain MorningHello features.
11. Cards and Reminders
Cards are provided for personal, noncommercial use.
Users may send them through iMessage and other compatible applications.
Commercial use of the cards without written permission from MorningHello is prohibited.
Communication reminders are stored locally on the user’s device, are not emergency notifications, are not disclosed to emergency contacts, and do not affect the deadline for the next “I’m OK” check-in.
12. Intellectual Property
The MorningHello name, logo, design, interface, text, structure, software code, collections, and cards belong to MorningHello or are used lawfully.
13. Personal Data
The processing of personal data is described in the MorningHello Privacy Policy.
Depending on the features used, MorningHello may process profile information, a telephone number, country of residence, subscription information, emergency-contact information, monitoring data, pet information, and a photograph of pet food packaging.
The information is used only to provide MorningHello features, manage subscriptions and access, operate server-based monitoring, send service and emergency messages, apply regional settings, and assist a pet following a missed check-in.
Emotional check-ins and communication reminders are stored locally on the device and are not transmitted to the Backend unless the user is expressly informed otherwise before such transmission begins.
Deleting the App from an iPhone may not delete information previously transmitted to the server.
To request access to, correction of, or deletion of personal information, the user may contact:
Deletion may be limited by legal obligations concerning subscription, payment, security, and compliance records.
14. Third-Party Services
MorningHello may depend on Apple, the App Store, iOS, Amazon Web Services, Amazon SES, telecommunications providers, email services, and messaging applications.
The use of such services may also be governed by their own terms of use and privacy policies.
15. Disclaimer of Warranties
To the extent permitted by law, the Service is provided “as is” and “as available.”
MorningHello does not guarantee uninterrupted operation, delivery of every notification, or the immediate availability of an emergency contact.
16. Limitation of Liability
MorningHello does not replace emergency services, medical, veterinary, or social assistance, or backup methods of communication.
Users are responsible for the accuracy of the information they enter and for keeping emergency contacts, telephone numbers, country of residence, and pet-care instructions current.
17. Governing Law
These Terms are governed by the laws of the State of Israel, without limiting any mandatory consumer rights that apply where the user lives.
18. Third-Party Services and Links
MorningHello relies on third-party platforms and services, including Apple, the App Store, iOS, Amazon Web Services, Amazon SES, Wix, telecommunications providers, email services, and messaging apps. Their own terms and policies may apply to the relevant services.
MorningHello does not control the availability, security, content, or changes of third-party services and, to the extent permitted by applicable law, is not responsible for their actions.
19. Changes, Suspension, and Termination of the Service
MorningHello is under development and may change its functions, design, postcards, supported holidays, technical architecture, and prices. Material changes to these Terms will be published on the Website or communicated in the App before they take effect where required by law.
We may temporarily restrict or suspend the Service for maintenance, security, compliance with legal requirements, or prevention of misuse. A particular User’s access may be restricted if the User materially breaches these Terms.
If MorningHello discontinues a paid function, the User’s entitlement to a refund or continued access will be determined by applicable law and Apple’s rules.
20. Disclaimer of Warranties
To the extent permitted by law, the Service is provided “as is” and “as available.” MorningHello does not warrant that the Service will operate continuously, without errors, on every device, or in every country, that every postcard will be available on a particular date, or that every notification will be delivered.
We do not provide medical, psychological, legal, or emergency advice. Users make their own decisions about communicating with people close to them.
Nothing in these Terms excludes warranties or consumer rights that cannot be limited by agreement.
21. Limitation of Liability
To the extent permitted by applicable law, MorningHello is not liable for indirect, incidental, special, or consequential losses, loss of data, profits, or use arising from the use of or inability to use the Service, non-delivery of a notification, a false or premature notification, or the actions of a User, contact, or third-party service.
This limitation does not apply to liability that cannot be excluded by law, including liability for willful misconduct, gross negligence, breach of mandatory consumer rights, or harm to life or health where provided by applicable law.
The User is responsible for the accuracy of the information entered, the lawful disclosure of contact information, maintaining backup methods of communication, and complying with these Terms.
22. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Israel, without prejudice to mandatory consumer rights and data protection rules applicable in the User’s country of residence.
Before commencing court proceedings, the parties will attempt to resolve the dispute through a written request sent to krylov.oxana@gmail.com. If the dispute is not resolved, it will be heard by a competent court in Israel unless mandatory applicable law gives the User the right to bring proceedings in the courts of their place of residence or requires a different procedure.
23. Severability and No Waiver
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect, and the invalid provision will be applied to the maximum extent permitted.
MorningHello’s failure to enforce a right immediately does not constitute a waiver of that right.
24. Entire Agreement
These Terms, the Privacy Policy, applicable Apple terms, and the subscription information displayed in the App Store constitute the agreement between the User and MorningHello regarding the Service. In the event of a conflict, mandatory provisions of law take precedence.
